Eligibility

You must be at least 18 years old to use the Service.
During registration you must provide your date of birth and confirm that you are at least 18 years old.
You are responsible for ensuring your use is legal where you live.

Accounts

You must provide accurate information and keep your account secure.
You are responsible for all activity under your account.
We may suspend or terminate accounts for violations of these Terms.

You retain ownership of content you upload. You grant us a limited license to host, store, reproduce, and display your content as needed to operate the Service and provide features you use (for example showing your portfolio).

You must have the rights to upload content. Do not upload content that violates laws or third-party rights.

Content rules (including sensitive content)

Users must respect privacy, consent, and intellectual property.
We may remove content or restrict visibility to comply with law, safety, or platform rules.
All NSFW content (Topless, Nude, Erotic, Explicit Nudity) is visible only after successful login and, where required, after age verification. Non-logged-in visitors see zero NSFW images.
For strictly prohibited categories of content, see the Prohibited Content (Hard Bans) section below.

Acceptable use

You agree not to:

Abuse or attempt to break security (scraping, reverse engineering, attacks)
Circumvent access controls
Use the Service to harass, spam, or defraud others

Service availability and changes

We may modify, suspend, or discontinue parts of the Service where reasonably necessary for legal, safety, security, technical, operational, or product reasons.

Limitation of liability

We are liable without limitation for intent and gross negligence, and for damages resulting from injury to life, body, or health.

In case of simple negligence, we are liable only for breaches of essential contractual obligations (cardinal obligations). In such cases, our liability is limited to the typical, foreseeable damage.

In all other cases, liability is excluded to the extent permitted by law.

Termination

You may stop using the Service at any time. We may terminate or suspend access if you violate these Terms or for security reasons.

Privacy and cookies

Your use of the Service is also governed by our Privacy Policy and Cookie Policy.

Community Guidelines (Netiquette)

We want a respectful, professional, and safe community. By using the Service, you agree to:

Treat others with respect. No harassment, insults, doxxing, threats, or hate speech.
No spam, scams, impersonation, or misleading claims.
Keep interactions relevant and constructive. We may remove disruptive "off-topic" content that harms the community.
Respect privacy. Do not share private information of others without permission.

There is no legal entitlement to access the Service or community features. We may restrict participation (in whole or in part) if you violate these rules or applicable laws.

Content Standards and Definitions

We support photography and portfolio content, including adult-oriented work categories, but explicit pornographic content is prohibited on the Service.

Definitions

Nudity: images showing nipples and/or genital area (crotch). Nudity can be artistic, editorial, or adult-oriented.
Erotic: images that simulate sexual acts or clearly suggest sexual interaction between two or more persons, without showing explicit sex acts.
Explicit Nudity (18+): full-frontal nudity, visible genitals, explicit close-ups of genitals, open-leg poses, or intimate/sensual touching, provided no sexual acts are depicted.
Pornography (explicit sexual content): any depiction of sexual acts, including sexual intercourse, oral sex, penetration, masturbation, or explicit genital stimulation.

Nudity and explicit-content policy

Pornographic content (explicit sexual acts) is strictly prohibited on PortfolioReach in all areas, including Private/MySecretCorner.
"Adult" is a work/booking category only and does not permit uploading or sharing pornographic/explicit content.
We do not proactively review private content, but we act on reports and enforce removals, restrictions, and account sanctions.
For clarity: Nudity/Erotic/Explicit Nudity content without explicit sexual acts may be allowed where permitted by account settings, age-gating, and visibility rules.
We maintain a zero-tolerance policy for illegal content (especially CSAM).

Age requirement for adult-oriented content

Any Nudity, Erotic, or Explicit Nudity content is 18+ only.
You must not upload content involving minors or persons who appear to be minors. This is strictly prohibited and will be reported where required.

Jurisdiction-based age verification

In jurisdictions where law, regulatory requirements, or enforcement practice require higher-assurance age verification, access to 18+ content may require full age verification through approved third-party providers.
Full age verification is triggered only when needed (for example, when a user attempts to access or unblur 18+ content), not at sign-up.
Current stricter jurisdictions include: DE, FR, IT, ES, UK.
We may add jurisdictions to, or remove jurisdictions from, this stricter list to reflect legal or regulatory changes.
Outside stricter jurisdictions, access to 18+ content may rely on lighter safeguards (for example, login, blur, or click-to-unblur) and may not require full age verification.
The "Age verified (18+)" badge is issued only after successful full age verification in a stricter jurisdiction and may be revoked for security or compliance reasons (e.g., account takeover signals, credential changes, or policy violations). The badge does not expire automatically.

Visibility Rules (Public vs Private)

Public areas

Explicit pornography is prohibited everywhere (Public and Private/MySecretCorner).

We may also restrict visibility of other adult-oriented content depending on safety, local law, or platform integrity.

Private area (MySecretCorner)

Content marked as "Private" is shown only in your private area ("MySecretCorner") and is not accessible from public profile views.

You are responsible for correctly marking Private content. Attempting to upload or share explicit pornography in any visibility is a serious violation.

Private Sharing and Consent

Private content may be shared with other users through expiring links or direct sharing features (if enabled), but only for content allowed under these Terms.

Expiring share links for private photos

We may allow you to generate expiring share links for photos marked as Private. These links are intended for controlled sharing.

A share link requires a logged-in PortfolioReach account before any preview, metadata access, or reporting action is available.
Share links expire automatically after a limited time or can be revoked by the owner at any time.
If a photo is deleted or its visibility changes from Private to another setting, existing share links may stop working.
If content is reported or found to violate these Terms, share links may be automatically revoked.
We may enforce anti-abuse limits (for example limits per photo) and apply rate limiting or other security measures.

Expiring links - important notice

Expiring links reduce the time window for access, but they do not guarantee confidentiality. Recipients may still download, copy, screenshot, or otherwise reproduce content once they can view it. You share private links at your own risk.

Nudity levels used in the Service

We use the following nudity levels as classification labels to help enforce visibility, sharing rules, and age-gating across the Service. These levels describe how explicit the nudity/sexual context is, not whether the content is automatically allowed or disallowed.

Levels

None - No nudity.

Implied Nudity - suggestive, but no visible nipples or genitals.

Topless - Visible nipples (where applicable).

Nude - Visible nipples and/or visible genitals in an artistic or photographic composition.

Erotic - Sexually explicit posing or simulated sexual actions without explicit sex acts (no visible penetration).

Explicit Nudity - full-frontal nudity, visible genitals, explicit close-ups of genitals, open-leg poses, or intimate/sensual touching, provided that no sexual acts are depicted (for example no intercourse, oral sex, penetration, masturbation, or explicit genital stimulation).

Adult - Explicit sexual content / pornography (explicit sex acts).

What is prohibited vs allowed (in plain terms)

Prohibited everywhere (Public and Private/MySecretCorner): any material that shows explicit sex acts, including (non-exhaustive) penetration, oral sex, masturbation, ejaculations, or content primarily intended to depict explicit sex acts.

May be restricted to Private (MySecretCorner) and/or age-gated: Erotic and Explicit Nudity content (simulated sexual context or highly explicit nudity without explicit sex acts). We may restrict it depending on category, local law, and moderation.

May be allowed publicly (if correctly tagged and compliant): None, Implied Nudity, Topless, Nude.

Public visibility

Content classified as Adult is prohibited everywhere (Public and Private/MySecretCorner).

Erotic and Explicit Nudity may be restricted to Private and/or age-gated depending on category, local law, and moderation decision.

None, Implied Nudity, Topless, Nude may be allowed publicly if properly tagged and not violating other rules.

Important notes

Correct tagging is mandatory. Uploading content with a lower level than required is a violation of these Terms.

We may apply additional restrictions (blur, age-gating, limited preview, reduced discoverability, forced Private, removal) where required by safety rules, moderation policy, or law.

External Links (Supported Profile Links)

To reduce scams, impersonation, and unsafe redirects, third-party links may only be added through designated, supported profile link fields ("supported hooks").

Supported profile link destinations may include selected social media, websites, and creator-profile services enabled by PortfolioReach.

Any attempt to bypass this policy (for example by obfuscated links, link shorteners, or redirect chains) may result in removal or account action.

We do not allow links to escort services, prostitution-related services, or marketplaces for explicit or sexually exploitative goods in profile fields or public content.

Prohibited Content (Hard Bans)

You must not upload, share, or promote:

Pornography / explicit sexual acts (for example penetration, oral sex, explicit sex acts).
Bestiality / zoophilia.
Any content involving minors or persons who appear to be minors (including "ageplay" or similar).
Non-consensual sexual content, revenge porn, blackmail, or coercion.
Incest content or content sexualizing family relationships.
Extreme fetish content involving feces/scat, urine, vomit, or blood/bodily fluids.
Exploitation, trafficking, or sexual violence content.
Extreme violence or gore presented without clear artistic/contextual intent (we may remove even with context).
Hate speech, racist content, or content that targets protected groups.
Illegal content or instructions to commit illegal acts.
Copyright-infringing content you do not have rights to use.

We may remove prohibited content immediately and may report it to relevant authorities where required.

Rights and Permissions for Uploads

You may upload content only if you have all necessary rights and permissions, including:

Rights from the creator (photographer/videographer) where applicable
Consent from all identifiable persons shown
Any required model releases for publication and sharing

You are responsible for the content you upload and any consequences of sharing it.

Moderation and Enforcement

We have full discretion to moderate the Service to protect users and comply with law.

We may, without prior notice:

Remove or restrict access to content
Change visibility (for example force Private or disable sharing)
Disable expiring links
Limit features, suspend, or terminate accounts
Restrict search/discovery for safety

Sanctions may include warnings, temporary suspensions, permanent bans, and device/IP restrictions in cases of abuse (spam, harassment, hacking attempts, repeated violations).

Moderators' instructions must be followed. Attempts to evade moderation actions (for example re-uploading removed content) are a serious violation.

Reporting and Appeals

If you see content or behavior that violates these Terms, use the reporting tools (if available) or contact support.

We aim to review reports, but we cannot guarantee immediate action in all cases.

You may appeal a moderation decision by contacting support. We may request additional context or verification.

This translation is provided for user convenience. In the event of discrepancies, the German version shall be used as the reference version.
